What is Upper Deck Thinking?- We Have the Answers!

Card Corner Club Headlines - Fri, 02/05/2010 - 15:45

Card Corner Club has obtained the official Opposition Brief, filed by Upper Deck in response to the request by Major League Baseball Properties to issue a temporary restraining order on the distribution of questioned baseball cards.

Upper Deck makes it's case and provides their legal reasonings for producing baseball trading cards that use, what was thought to be, exclusive licensed logos and trademarks.

The attached document addresses these issues and more.

A. MLBP Has Not Shown That It Will Suffer Irreparable Harm
B. MLBP Is Not Likely to Succeed on the Merits Of Its Trademark Claims
1. MLBP Has Not Shown Consumer Confusion Is Likely
2. Upper Deck Cannot Compete In The Market For Baseball Cards Unless It Can Produce Cards that Contain Action Photographs of Baseball Players in Their Uniforms
3. Upper Deck’s Use of MLBP’s Marks Is Nominative Fair Use
4. MLBP Has Not Shown That Dilution Is Likely
C. MLBP Will Not Succeed On The Merits of Its Breach of Contract Claim
1. The License’s Language Prohibiting Non–Trademark Use Of The MLBP’s Marks After Expiration Of The License Is Unenforceable

The Danica Age is Upon Us – Press Pass’ Wheels Element In Stores Now!

Card Corner Club Headlines - Thu, 02/04/2010 - 23:14

And so it begins. The Danica Patrick rookie card has arrived and it is part of a beautiful vintage style Press Pass NASCAR release titled Element. Priced at around $80, Element has 24 packs per hobby box for you to dig into and press the pedal to the metal in search of Danica and those other guys…

Ok, seriously, on average you’ll find an autograph and a memorabilia card of a NASCAR personality in each and every box. If the collation is solid you’ll definitely get a Danica rookie, you won’t have to hunt it down as the 100-card set can be attained with a lone box. The chase card will be the green bordered parallel variation; those are seeded 1:6 packs.

Now with a lead in of Danica, do you really need anything else to hype the product? The answer is of course – NO! But, Press Pass has done some amazing things with Element. First off, the collection is printed on completely recycled stock. That stock is not the glossy white stuff we’ve been used to seeing, it is an old-school, traditional brown back cardboard and I personally love it. It’s a cool theme if you think about it, especially since most of the NASCAR memorabilia used by Press Pass are recycled car parts anyway!

2009 Bowman Draft Picks and Prospects Baseball Confuses Me

Card Corner Club Headlines - Tue, 02/02/2010 - 14:01

This set has some nice World Baseball Classic cards but that gets buried under the confusion when it gets down to the time when you are sorting your booty are cracking open a box. I love getting rookie cards and prospect cards but then there are 1st Bowman cards and then 1st Bowman Chrome cards, and 1st Bowman Chrome Certified autographs. Not to mention a multitude of serial-numbered cards. For around $65 the price is right but you have to save every card and hope that some of these players turn into gems.
